• The photograph is credited to the Associated Press. It is a wire photo, which the Associated Press distributed copies of to its member newspapers.
• The 1909 Copyright Act, which was law until 1977, stated that any item had to be published with the copyright symbol ©, the word "Copyright", or the abbreviation "Copr."
• This photograph was clearly not sent with such a notice (see the full image and the back of the photo below, under "file history").

This work is in the public domain in the United States because it was published in the United States between 1931 and 1977, inclusive, without a copyright notice.
